Scream AI is an AI-powered image transformation service that creates Y2K horror-themed photos. The Service allows users to upload photos and receive AI-generated images with horror aesthetic elements.

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use this Service
• One person or legal entity may maintain no more than one account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload content that infringes on intellectual property rights

• AI-generated images created through the Service are provided for your personal or commercial use
• You are responsible for ensuring your use of generated images complies with applicable laws
• We do not claim ownership of the generated images

The Service, including its original content, features, and functionality, is owned by Scream AI and is protected by international copyright, trademark, and other intellectual property laws.

6. Subscriptions and Payment

6.1 Subscription Plans

• We offer various subscription plans with different credit allocations
• Subscription details and pricing are available on our pricing page
• Prices are subject to change with 30 days notice

6.2 Payment Processing

• Payments are processed through our payment provider, Creem.io
• You agree to pay all fees associated with your subscription plan
• Subscriptions automatically renew unless canceled

6.3 Credits

• Credits are consumed when generating images
• Unused monthly credits do not roll over to the next month
• Credits have no cash value and cannot be transferred

7. Refund Policy

• Monthly subscriptions can be canceled at any time
• No refunds are provided for partial month usage
• Refunds may be provided at our discretion for technical issues preventing service use

8. Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
• We reserve the right to modify or discontinue the Service with notice
• We may perform maintenance that temporarily affects availability

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCREAM AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Scream AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

• We may terminate or suspend your account immediately, without prior notice, for violation of these Terms
• You may terminate your account at any time through your account settings
• Upon termination, your right to use the Service will immediately cease
• Provisions that by their nature should survive termination shall survive

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in the United States.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
